Revised APM 035
updates the Affirmative Action and Nondiscrimination in Employment
policy to conform with the Uniformed Services Employment and
Reemployment Rights Act of 1994, the Jobs for Veterans Act of 2002 as
well as regulations to prohibit retaliation.
Revised APM 220-18-b(4),
Criteria for Advancement to Professor Step VI and Professor
Above-Scale, clarifies that an overall career review is necessary for
advancement to Step VI as well as advancement to an Above-Scale rank.
Also greater emphasis is given to teaching and creative activity in
determining advancement than on service. The policy is effective
September 2, 2008 for implementation no later than July 1, 2009.
The change to
APM 220-85-b corrects a technical error in numbering resulting
from a past policy revision. APM-220-80-e was incorrectly referenced in
this section. The text was corrected to reflect the appropriate policy
reference, APM-220-80-g.
APM 335-10-a
deletes the educational requirement from Cooperative Extension Advisors,
making the criteria consistent with the criteria for Specialists in
Cooperative Extension (APM-334-10-a).
Revised
APM 740-11-c
adds the following Laboratory administrative titles to those titles
eligible to accrue sabbatical leave: Laboratory Director, Deputy
Laboratory Director and Associate Laboratory Director.
APM 350
is rescinded on the basis that the policy has been rendered obsolete by
the provisions of APM 390 issued on July 1, 2003.

Academic Personnel Policy 190, Appendix
A-1 (Whistleblower Policy) has been revised effective July 16, 2008.
The University of California Policy on Reporting and Investigating
Allegations of Suspected Improper Governmental Activities (Whistleblower
Policy), set forth in APM 190, Appendix A-1, was revised on April 2,
2008, to reflect responsibilities of the Senior Vice President, Chief
Compliance and Audit Officer.
The revised policy supersedes the earlier version of the “Whistleblower
Policy” dated October 4, 2002. Please note that the University of
California Policy for the Protection of Whistleblowers from Retaliation
and Guidelines for Reviewing Retaliation Complaints (Whistleblower
Protection Policy), set forth in APM 190, Appendix A-2, dated October 4,
2002, is still in effect.

These changes to the
Academic Personnel Manual are the result of several years of discussion
and consultation aimed at (1) codifying certain sick leave and medical
leave provisions for academic appointees, (2) establishing a systemwide
framework to support the University’s commitment to reasonable
accommodation for academic appointees who are disabled or who become
disabled, and (3) introducing a medical separation policy for academic
appointees. These policies take effect July 1, 2008.
APM 710 has
been revised with a new section, APM 710-11, which establishes a maximum
of paid medical leave to be granted to eligible faculty members who do
not accrue sick leave in cases of personal illness, injury or
disability. Other revisions to APM 710 expand the list of academic
titles eligible to accrue sick leave, as well as expanding sick leave
accrual to appointees in these titles who hold academic year
appointments; and provides guidelines for how and when departments
should request medical information in support of requests for sick and
paid medical leave.
New APM 080
outlines the process for medical separation of academic appointees who
have exhausted periods of leave and continue to be unable to work for
health reasons, and for whom reasonable accommodation is not possible.
This new policy provides a means to handle this issue in a sensitive and
respectful manner by establishing a process that keeps such cases
distinct from disciplinary actions resulting from misconduct or
incompetent performance.
New APM 711
complies with federal and California law – most specifically, the
Americans with Disabilities Act (ADA) and the Fair Employment and
Housing Act (FEHA) in establishing systemwide policy governing the
interactive process to determine reasonable accommodation for otherwise
qualified academic appointees with disabilities.
The addition of
these policies will provide much-needed guidance in disability
management for academic personnel, as well as establish a consistent
level of paid medical leave for academic appointees systemwide. To
ensure that academic appointees and campus administrators understand the
provisions of these policies, the Academic Advancement department at the
Office of the President is preparing links on the Academic Personnel Web
page to definitions of important terminology, the text of applicable
laws, and answers to frequently asked questions. For more information,

Enclosed is a
technical revision to the University of California Policy on Sexual
Harassment.
The new policy
reflects a technical revision that deletes “counselors” from the list of
University employees designated responsible for reporting sexual
harassment. The designation conflicts with a provision in the Sexual
Harassment Procedures indicating that licensed counselors are
confidential resources with whom employees may consult and that such
consultations will not result in reports of sexual harassment, absent
additional action by the employee.
This revised policy
is effective February 10, 2006 and supersedes the December 14, 2004

These academic
personnel polices were developed over the last few years and reviewed by
campuses, the Academic Senate, the Office of the General Counsel,
employee organizations and affected employees. While there has been
consensus on the importance of issuing formal personnel policy for
Academic Appointees who provide supervision for the University’s health
sciences trainees, it has been particularly difficult to decide upon an
appropriate name for the different categories of appointees. The
feedback received from various reviewers made it clear that it is
necessary to retain the use of the title Clinical Professor for those
community health care providers who volunteer their services to the
University. For that reason, we have chosen the title Health Sciences
Clinical Professor for those faculty who are compensated by the
University or by one of the University’s formal affiliates, and who are
currently classified as Clinical Professors.

Continuing Educator Salary Scale
Revised APM 340 will
replace the current Continuing Education Specialist title with the title
of Continuing Educator. The basis of the new title was a proposal
developed by the UNEX Deans, who have requested increased control and
flexibility in administering Extension. Continuing Educators design and
implement continuing education programs and classes for the public,
primarily through University Extension.
Revised APM
662–Appendix B-4, addresses additional compensation for University
Extension academic appointees, such as Academic Coordinators and
Continuing Educators, who have financial or academic responsibility for
University Extension courses and who also teach in University Extension
programs.
The Transition
Guidelines provide instructions for transitioning from an existing
Continuing Education Specialist title to the new Continuing Educator
title with its new salary range. The transition is to be completed by
July 1, 2006.
Lastly, the new
salary range for each level of the Continuing Educator titles will
provide increased salary flexibility and is designed to enhance career
opportunities. In addition, under APM 340-10, the Chancellor may
authorize an incentive plan to reward exceptionally meritorious
performance.

A Strategic Review
Panel convened by President Atkinson recommended in May 2003 that
educational outreach be incorporated into the teaching and research
mission of the University. The Panel asked the Academic Senate to
develop the means by which faculty could be properly recognized and
rewarded for their contributions to the University's commitment to
diversity and access.
The University
Committee on Affirmative Action and Diversity and the University
Committee on Academic Personnel developed these proposed revisions to
APM 210-1-d, 240 and 245. On October 25, 2004, the Academic Council
endorsed the attached APM revisions with the hope that “these changes
will lead to more faculty engagement in educational outreach
activities.”
In addition to
recognizing the academic importance of faculty efforts to advance
diversity in higher education, these policy revisions underscore the
importance of diversity as a core value of the mission of the University
of California.

Enclosed is revised Academic Personnel Policy 200-22, Recall
Appointments for Academic Appointees, which is effective January 14,
2005. Appendix A, the new Pre-Retirement Recall Guidelines for Faculty
Recalled for Post Retirement Teaching, apply to faculty who are age 60
or above and have at least five years of University of California
Retirement Plan (UCRP) service credit at the time the recall appointment
is negotiated. Appendix B describes changes made in 2003 to the UCRP
Normal Retirement Age and the effect on post-retirement appointments.

Enclosed is revised
Academic Personnel Policy 120, Emeritus Titles, which is effective
January 14, 2005. The revision, added as a footnote to the Academic
Personnel Manual in APM 120-10, expands the definition of retirement for
purposes of granting Emeritus status as provided in Standing Order of
The Regents 103.5 by conferring Emeritus status on those faculty who
separate from UC while receiving disability income from UCRP, granted
they are otherwise eligible for Emeritus status.
The amendment also
clarifies the existing practices of: (1) Granting Emeritus status only
to those faculty who retire within 120 days of separation from UC and
(2) Granting Emeritus status to faculty who take Lump Sum Cashouts
within 120 days of separation from UC rather than regular service
retirement.
This policy has been
reviewed by campuses, the Academic Senate, the Office of the General
Counsel, employee organizations and affected employees.

University of California Policy on Sexual Harassment and Procedures for
Responding to Reports of Sexual Harassment
Enclosed are the
revised University of California’s Policy on Sexual Harassment and the
associated Procedures for Responding to Reports of Sexual Harassment
which cover all members of the University community. The policy and
procedures are added to the Academic Personnel Manual as APM 035,
Appendix A-1 and Appendix A-2, respectively and are effective December
16, 2004. The new policies supersede the Policy on Sexual Harassment and
Complaint Resolution Procedures issued on April 23, 1992.
As detailed in
Executive Vice Chancellor Neuman’s memo dated January 26, 2005, the
major components of the procedure require each location to designate a
Title IX Compliance Coordinator (Sexual Harassment Officer) to receive
reports of sexual harassment, oversee sexual harassment prevention
programs, and to develop procedures for responding to reports of sexual
harassment, including provisions for early resolution and formal
investigation. Managers and supervisors play a key role in appropriately
responding to reports of sexual harassment and notifying the Title IX
Compliance Coordinator of reports received.
Revisions to the
policy also include an updated definition of sexual harassment,
clarification of the University’s obligation to respond promptly and
effectively to reports of sexual harassment, provisions for training
employees and educating the University community regarding sexual
harassment, and a statement that the policy shall be implemented in a
manner that recognizes principles of free speech and academic freedom.

The
University of California nondiscrimination policies, including APM 035 on
Affirmative Action and Nondiscrimination in Employment, have been revised
effective January 1, 2004, to clarify that discrimination on the basis of
gender identity and pregnancy is prohibited.
The
changes incorporate the addition of “gender identity” as a protected
status under the California Fair Employment and Housing Act.
Discrimination on the basis of pregnancy is included within the category
of discrimination based on “sex.” The term “pregnancy” has been added to
these notices to facilitate understanding of University policy in this
regard.

Enclosed is revised Academic Personnel
Policy 010 on Academic Freedom which is effective September 29, 2003.
This new statement on academic freedom
for faculty supersedes the previous APM 010. The policy is based on the
traditional cornerstones of academic freedom -- freedom of inquiry and
research, freedom of teaching, and freedom of expression and publication.
The policy establishes that faculty have primary responsibility for
articulating the professional standards by which academic freedom may be
sustained.
This new policy does not seek to change
in any way the authority of the Board of Regents to govern the University
of California, or the responsibility of the Administration to perform its
appropriate role in governance. The policy is intended to be read in
conjunction with APM 015 (Faculty Code of Conduct) and with The Regents'
1970 policy on academic freedom. Although this new policy applies to the
University's faculty, its issuance does nothing to diminish the rights and
responsibilities enjoyed by other academic appointees.

These revisions follow from changes made
to Regents' policy at the July 2003 meeting and changes made to Standing
Order 103.4 of The Regents at their September 2003 meeting. The three
major revisions are the following:
§
As an exception to policy, a
faculty member will be allowed to substitute significant University
service for some or all of the teaching requirement for a
sabbatical-in-residence.
§
Recipients of a sabbatical leave
at less than full salary will be allowed to receive additional
compensation for research from another university.
§
As part of the policy on other
leaves with pay (APM 758), a faculty member who holds a full-time
administrative position for five years or more will be allowed to take
an administrative leave immediately after that service. This leave will
be in lieu of a sabbatical leave.

Academic Personnel Manual (APM) regarding University Researchers in
academic titles: APM 310 on the Professional Research series; a new APM
311 on the Project (e.g., Scientist) series and accompanying salary
scales; a revised APM 620-14 on Off-Scale Salaries which includes new
titles; and transition guidelines, all effective August 1, 2003.
Revised APM 310 emphasizes that
appointees to the Professional Research series perform research equivalent
to ladder-rank faculty, engage in independent research, can function as
Principal Investigators (with campus approval), and have the major
responsibility for their research programs.
APM 311 adds the new Project (e.g.,
Scientist) title for appointees who make significant and creative
contributions to a research program in any academic discipline. Appointees
are not required to carry out independent research and would not normally
serve as Principal Investigators.
Revised APM 620-14 adds the Professor of
Clinical (e.g.,Medicine) series and the Project (e.g.Scientist) series as
eligible titles for off-scale salaries.

Academic Personnel Policy 015, the Faculty Code of Conduct which is
effective July 24, 2003.
Part II, Section A now
sets forth ethical principles and unacceptable conduct with regard to
faculty members and their students. The revised policy prohibits a faculty
member from entering into a romantic or sexual relationship with any
student for whom that faculty member currently has or prospectively might
have academic responsibility (as defined). The policy also prohibits a
faculty member from exercising academic responsibility for any student
with whom that faculty member has a romantic or sexual relationship.
The revisions to APM
015 were approved by the Assembly of the Academic Senate on May 28, 2003,
and adopted by The Regents on July 17, 2003.

Postdoctoral Scholars
Enclosed is a new
academic personnel policy on Postdoctoral Scholars, APM 390. The policy
will be implemented in two stages starting July 1, 2003. Details are
provided in the enclosed Transition Guidelines, which have been attached
formally to APM 390 as Appendix A.
The development of APM
390 was undertaken in response to national and University of California
discussions and reports on postdoctoral education over the past five
years. During
the formal review of this
policy, comments were received from the campuses, the Academic Council and
Senate committees, several UC postdoctoral scholar associations, and the
Office of General Counsel.
The new policy applies
to (1) postdoctoral employees funded from research grants; (2)
postdoctoral fellows and trainees funded from fellowships or traineeships
paid through University accounts; and (3) postdoctoral fellows and
trainees funded from fellowships or traineeships paid directly to the
individual. APM 390 establishes three new titles for Postdoctoral
Scholars to cover the three types listed above.
Three principal issues
emerged from the formal review. First, adequate flexibility was requested
with respect to the provision limiting postdoctoral service to a maximum
of five years, including postdoctoral service at other institutions. The
final policy provides exceptions for a sixth year. Second, with regard to
flexibility concerning the minimum salary/stipend and 100 percent time
requirements, the policy retains strict provisions for full-time
appointments at minimum salary rates in view of the need to provide
compensation at levels commensurate with Postdoctoral Scholars’
educational backgrounds and qualifications, and to recognize that the
postdoctoral experience is essentially full time. Third, the policy
provides for no vacation accrual and instead offers a provision for time
off during intersession and break periods or at alternative times to be
arranged by the Postdoctoral Scholar and mentor.
As the Transition
Guidelines indicate, all aspects of APM 390 will apply to new Postdoctoral
Scholars effective July 1, 2003, except the health benefits, sick leave
and time off provisions, which will go into effect later in the year.
The University is
currently developing a Postdoctoral Scholars benefits package that will
provide medical, dental, and vision plans and certain other benefits.
These plans will become operative later in the year. Information about
these benefit plans will be provided in Fall 2003.
Concurrently with the
issuance of APM 390, language has been added to APM Sections 140, 145,
150, 710, and 730 to indicate that these policies on layoff, grievance,
and leaves do not apply to individuals appointed in a Postdoctoral Scholar
title.

Revised APM 140, 145 and 150 apply to
Non-Senate academic appointees who are not covered by a Memorandum of
Understanding. These supersede existing policies. Revisions to APM 140
provide for a clearer and more timely grievance process. Revisions to APM
145 set good cause standards for instituting layoff and involuntary
reduction in time and clarify procedures for grieving layoff decisions.
Revisions to APM 150 clarify good cause standards and procedures for
instituting corrective action or dismissal.

Effective July 26th, the President issued revised APM 135, Security of
Employment; revised APM 210-3, Instructions to Review Committees; and a
new Academic Personnel Policy 285, Lecturer with Security of Employment.
The
Lecturer with Security of Employment (SOE) series is designed to meet the
long-term instructional needs of the University which cannot be best
fulfilled by an appointee in the regular professorial series or a
temporary Lecturer appointment.
On
May 29th, the Academic Assembly recommended that full-time Lecturers with
Potential for Security of Employment (PSOE) and full-time Senior Lecturers
with PSOE be granted Academic Senate membership. On July 18th, The
Regents revised Standing Order 105.1 to extend Senate membership to
full-time faculty in these titles.
This policy also effects the Lecturer Series in The UCLA CALL, page 134.
Senate Membership for Lecturer PSOE and Senior Lecturer PSOE will be
changed to “Yes” to adhere to the new policy.

Enclosed are revised Academic Personnel Policy
015, The Faculty Code of Conduct, and new Academic Personnel Policy 016,
University Policy on Faculty Conduct and the Administration of Discipline,
which are effective January 1, 2002, and supersede existing Academic
Personnel Policy Section 015.
APM 015 sets forth professional rights of faculty -- both general, ethical
principles for faculty and examples of unacceptable faculty conduct -- and
rules and recommendations for the enforcement of the Faculty Code. APM
016 includes general policy regarding faculty discipline. It specifies
the penalties that may be imposed for violations of the Faculty Code of
Conduct, what types of faculty behaviors are covered under the Faculty
Code, and which academic personnel are governed by the Faculty Code.
Revised APM 015 and new APM 016 were approved by the Assembly of the
Academic Senate on October 31, 2001, and adopted by The Regents on
November 15, 2001.

Re: Conflict of Commitment -- APM 025, 662, 740-19
Dear Colleagues:
This is to call your
attention to several important revisions to the Academic Personnel Manual
(APM). These revisions detail the criteria for undertaking outside
activities, and adds a provision for pre-approval, which in turn lifts
several traditional restrictions. Please review these revisions with
care. Enclosed are the following revised Academic Personnel Policy
sections:
- APM
025, Conflict of Commitment and Outside Activities of Faculty Members
- APM
662, Appendix B-1, and Appendix B-2; Additional Compensation/Additional
Teaching
- APM
740-19, Leaves of Absence/Sabbatical Leaves
APM
025 provides the framework by which University administrators and faculty
will assure all of the University’s constituencies that potential
conflicts of commitment are identified and appropriately managed, while at
the same time allowing faculty to engage in a wide array of outside
activities without unnecessary limitations. A key provision of the policy
is the requirement that faculty obtain approval before engaging in certain
specified types of activities. I have delegated this approval authority
to the Deans.
Also
provided with APM 025 are standardized forms to report outside
activities. These forms will be used next year when reporting 2001-2002
activities. Reporting for the 2000-2001 period should be done in
accordance with the guidelines and forms set forth in Appendix 19 of The
CALL. If you have not already done so, reporting of 2000-2001 activities
should be submitted to your Chair by the end of November.
Appendices B-1 and B-2 of
revised APM 662, focus on regulating the amount of time devoted to
additional teaching rather than on the amount of compensation earned.
This policy provides for the surrendering of consulting days for time
spent on additional teaching in self-supporting and continuing education
programs, including service to University Extension.
Revised APM 740-19 lifts current restrictions and allows faculty to engage
in compensated outside activities during sabbatical leaves to the same
extent that they are allowed to do so during the academic term.

Retirement Contributions on Academic
Appointee Summer Salary
Last
fall we circulated for review a proposal originated by the University
Committee on Faculty Welfare to institute contributions to the Defined
Contribution Plan for academic appointees who earn summer salary. After
extensive consultation, we took a recommendation for coverage of summer
salary to the Regents for approval.
We received approval
in November 2000 from The Regents to begin employer and employee
contributions to the Defined Contribution Plan Pretax Account on academic
appointee summer salary effective with summer salary payments made on or
after July 1, 2001. Enclosed is a more detailed description of
the new program.

Retirement Contributions on
Academic Appointee Summer Salary
Effective July 1, 2001
Compensation that many
academic appointees receive for summer session teaching or summer research
is not considered “Covered Compensation” for determining University of
California Retirement Plan (UCRP) benefits. Since summer salary can be a
significant portion of an academic appointee's annual earnings, The
Regents have determined that some coverage for retirement purposes is
appropriate. Therefore, an employer and employee contribution to the
Defined Contribution Plan Pretax Account based on those summer earnings
has been approved by The Regents, to be effective with summer salary
payments made on or after July 1, 2001.
Eligibility
Eligible employees are
academic appointees who:
1.
have Academic-Year (9/12) appointments;
2.
are active members of UCRP or a defined benefit plan to which UC
contributes; and
3.
earn eligible summer salary, as defined below.
Eligible
Summer Salary
For purposes of the
new retirement contribution, eligible summer salary is additional
compensation that is not Covered Compensation for purposes of defined
benefit retirement benefits and that is paid in accordance with
APM 660
for:
1.
summer research;
2.
summer teaching; and/or
3.
summer administrative service (generally, payments to Department Chairs,
Vice Chairs, etc. for administrative duties
paid as “1/9ths”).
EXCLUSIONS
Payments
from University Extension are excluded.

The total
contribution rate will be 7% of eligible summer salary, based on an
employee pretax contribution of 3.5% and an employer pretax contribution
of 3.5. The employer contribution will be attributed to the same funding
source that provides the academic appointee’s summer salary.

Over the course of the year, Academic
Advancement has worked with the campuses and the Senate to update and
streamline various sections of the Academic Personnel Manual. The
attachment to this letter provides a general overview of the technical
changes and lists the revised policies that reflect these changes, such as
standardizing delegations of authority, removing certain campus reporting
requirements to the Office of the President, and clarifying current
administrative authority. Additionally, obsolete sections have been
rescinded, namely APM 287—Visiting Lecturer and Adjunct Lecturer, APM
400—Associate and APM 510A—Special Procedures Concerning Permanent and
Temporary Academic Intercampus Transfers.
The new policies are accessible in .pdf
format and can be printed as needed directly from the web. Office of the
President plans to make the entire APM available in .pdf format in hopes
to eliminate the need to distribute hard copies in the future. Therefore,
we encourage departments to increase their usage of the online version of
the APM as well as the Adobe Acrobat Reader to view and print .pdf
files.

Re: New Policy on Termination
for Incompetent Performance – APM 075
Enclosed is a new Academic
Personnel Manual Section, APM 075, on Termination for Incompetent
Performance and Appendix A, Summary of Procedures which is effective
immediately.
The new policy applies only to
Academic Senate faculty with tenure or with Security of Employment. The
new policy reaffirms and clarifies current University policy that
incompetent performance constitutes good cause for dismissal, articulates
standards for evaluating faculty performance, and provides a thorough
process for review of such cases. Under the review procedure, the campus
Committee on Academic Personnel will evaluate the evidence and advise, on
the basis of the written record, whether the faculty member is performing
his or her University duties in a manner consonant with professional
standards of competence. In addition, the faculty member will be offered
the opportunity for an evidentiary hearing before the Committee on
Privilege and Tenure.
While it is important for the
University to have a policy addressing incompetent performance, the
reality is that the general quality of the University faculty performance
is superb. The stringent standard for termination and the detailed
procedures are designed to protect the institution of tenure and academic
freedom.

Re: APM 510B -- Guidelines on
Intercampus Recruiting
Enclosed are the revised Guidelines on
Intercampus Recruiting for ladder rank faculty. The Guidelines have been
revised to emphasize that the Chancellor of the recruiting campus must
notify the other Chancellor of the intention to make the offer to a
faculty member at the earliest possible opportunity. The Chancellor of the
recruiting campus is to provide written information concerning all of the
details of the offer – financial or otherwise and regardless of fund
source – including the proposed salary, any stipends or summer ninths,
teaching responsibilities and other recruitment incentives, as soon as
such information is available. The Guidelines also clarify the salary
level that may be offered to a faculty member by the recruiting campus.
The Guidelines shall be used in conjunction with the timing provisions of
APM 510, Intercampus Transfers.

Enclosed is the new Policy on
the Use of Non-19900 Fund Sources to Support Ladder-Rank Faculty which
is effective immediately. The policy has been reviewed by campuses, the
Academic Senate, the General Counsel, employee organizations and affected
employees.
Non-19900 fund support of
ladder-rank faculty is a departure from past practice. The Academic Senate
has provided cautious support for the new policy. Accordingly,
implementation will be carefully reviewed annually by the Office of the
President. In addition, in consultation with the Senate, a major review
will be conducted at the end of three years to identify problems and to
make needed changes in the policy. The Senate has expressed concerns that
differing capacities to generate non-19900 funds could result in
inequities across and between academic units and/or campuses. Each campus
should consider how non-19900 fund sources that support ladder-rank
faculty will benefit the campus as a whole.
In the decade ahead, the
University will recruit a large number of faculty consistent with
enrollment growth. Competition for the very best is likely to be intense
and expensive. Therefore, it will be especially important for the
University of California to marshal resources necessary to recruit and
retain a faculty to maintain primacy among the universities of the world.
The new policy can help in this endeavor.

Re: New Step IX Policy
– APM 220-18(b)(4)
The following is an excerpted
portion of a statement from the Office of the President. You will note
that it repeats the substance of a policy statement recently issued by my
office before Step IX was "official."
"Effective July 1, 2000, Step
IX will be added to the Professorial Salary Scales. This change will
affect the regular Academic-Year and Fiscal-Year Professorial Salary
Scales, the Business/Management and Engineering Academic-Year and
Fiscal-Year Salary Scales, the Law School Salary Scale, the Strict
Full Time Preclinical Medicine Salary Scale, the Strict Full Time
Veterinary Medicine Salary Scale, the Medical School Clinical
Compensation Plan, and the General Health Sciences Compensation Plan
Salary Scales. Step IX will permit senior faculty members whose work
continues to be meritorious to be further rewarded than is currently
possible.
Academic Personnel Manual
Section 220-18(b)(4) has been revised to reflect a change to the
normal period of service at Steps VIII and IX. The normal period of
service at Step VIII is three years, in conformance with the normal
period of service at the other professorial steps. The normal period
of service at Step IX is four years. The major review of full
professors will continue to take place at Step V.
During the transition phase,
individuals who are in at least their third year of service at Step
VIII in 1999-2000 will be eligible for consideration for advancement
to Step IX on July 1, 2000. In addition, individuals who are in at
least their fourth year of service at Step VIII in 1999-2000 will have
the option of requesting consideration for advancement to Above-Scale
status. This time line is not meant to preclude advancements from Step
VIII or lower to above scale, but extraordinary justification will be
necessary to advance a candidate directly from Step VIII or lower to
Above-Scale. As before, campuses have the flexibility and discretion
to determine faculty advancements in accordance with campus
procedures."
Salary adjustments will be made
so that no faculty member in Above-Scale status is paid less than $100
above Step IX on July 1, 2000. These adjustments will be funded from
campus merit funds. Please review the files of those faculty in
Above-Scale status and submit any necessary
adjustment proposals
to implement the foregoing policy. See the "Submission
Deadlines for Academic Actions effective July 1, 2000"
memo dated April 30, 1999 for instructions.

Re: Housing Allowance
Program, APM 190 Appendix E
Effective immediately, the new
maximum housing allowance is $50,000 per recipient under the Salary
Differential Housing Allowance Program for faculty. The new maximum will
continue to be indexed annually in accordance with the faculty salary
scale increase, and will be supported from campus funds. In addition,
exceptions to the new maximum will continue to require approval by the
Provost and Senior Vice President—Academic Affairs.
Current University guidelines do
not require repayment of housing allowances from recipients in the event
the faculty member chooses to leave the University after a short period of
employment. Campuses are hereby authorized to establish repayment
conditions on a local basis under the Salary Differential Housing
Allowance Program for faculty.
Agreements should be in writing
and campuses may establish repayment conditions uniformly or on a
case-by-case basis. For example, a campus may choose to structure
repayment conditions with the understanding that receipt of the housing
allowance at the $50,000 level is contingent on the faculty member making
a commitment to remain at the campus for a minimum period of five years.
If the faculty member leaves before the expiration of the five-year
period, a portion of the allowance would be repaid to the campus at a rate
of $10,000 per year of the unfulfilled commitment. Alternatively, a campus
may choose to structure repayment conditions such that the number of years
of commitment is less than five years or that the repayment rate is
graduated depending on the years of service to the University. Ultimately,
campuses have the flexibility to tailor the repayment conditions to the
individual faculty member receiving the housing allowance.

Re: Revised Endowed Chair Policy – APM

Enclosed are the systemwide revised Policy
on Endowed Chairs and Professorships and the Administrative Guidelines and
Procedures: Endowed Chairs and Professorships. The Policy and
Administrative Guidelines have been expanded and provide additional
flexibility and clarification about the administration and establishment
of endowed chairs and professorships, including distinguished
professorships and other similar arrangements. UCLA also has a campus
policy on Endowed Chairs that is set forth in The CALL,
Appendix 18,
page 247. The systemwide policy provides for a minimum sum of $350,000 to
establish an endowed chair or professorship.
In cases where a gift instrument has not
been finalized prior to the effective date of this revised Policy and
Administrative Guidelines and where provisions have already been
negotiated with donors which may be inconsistent with the new Policy and
Administrative Guidelines, campuses may "grandfather" those gifts with the
understanding that every effort has been made to structure the provisions
of the gift instrument to conform with the newly established endowed chair
policy and guidelines.
The revised Policy on Endowed Chairs and
Professorships and the Administrative Guidelines and Procedures: Endowed
Chairs and Professorships supersede the Policy on Endowed Chairs and
Professorships dated March 1996 and the Administrative Guidelines for
Campus Implementation of the Regental Policy on Endowed Chairs dated May
16, 1980. To provide easier access to the revised Policy and
Administrative Guidelines, they are now included in the Academic Personnel
manual as APM 191.

Enclosed are Academic Personnel Policies
710 (Sick Leave), 715 (Family and Medical Leave), 730 (Vacation) and 760
(Childbearing Leave, Parental Leave and Active Service-Modified Duties),
which are effective immediately and supersede existing policies. These
policies have been reviewed by the campuses, the Academic Senate, employee
organizations and affected employees.
Extensive changes were made to policies
710, 730 and 760 which clarify wording, illustrate the relation of these
leaves to applicable State and Federal law and add new provisions. For
example, eligibility requirements to accrue and use these types of leaves
are clearer. Provisions on the transfer of accrued sick leave and accrued
vacation, the reinstatement of accrued sick leave, and usage of accrued
vacation before the expiration of an appointment or expiration of a
funding source have been added. In recognition of shared childbearing
responsibilities, appointees with "substantial" responsibility to care for
a child before and/or immediately following birth or placement may now
request periods of Active Service-Modified Duties. Two charts have been
added to provide information on the timing of childbearing leaves,
childrearing leaves and periods of Active Service-Modified Duties.
New Policy 715 was developed to recognize
commitment to and compliance with the Federal Family and Medical Leave Act
and the California Family Rights Act. Related changes have been made to
Policy 133 (Limitation on Total Period of Service with Certain Academic
Titles) and Policy 700 (Leaves of Absence).
