Proposed revisions to 220-18-b(4) would clarify that an overall career review is necessary for advancement and place greater emphasis on teaching and creative activity in determining advancement than on service.

A technical revision to APM 220-85-b would correct an error in numbering that was recently brought to our attention. APM 220-85-b specifies that an “ad hoc review committee shall be appointed in accordance with the provisions of APM 220-80-e, and it shall carry out its duties as therein specified.”  The reference should be to APM 220-80-g.

Proposed revisions to APM 335-10-a would make the criteria for Cooperative Extension Advisors consistent with the criteria for Specialists in Cooperative Extension. One of the recommendations of the Cooperative Extension Advisor Status Task Force report on February 1, 2007 was to delete the minimum requirement of a Bachelor’s degree for the Cooperative Extension Advisor Series. The task force found that the educational background for appointees in this series is substantially higher, usually a Master’s degree or Ph.D.  The proposed deletion of the educational requirement from APM 335-10-a would make the criteria for Cooperative Extension Advisors consistent with the criteria for Specialists in Cooperative Extension (APM 334-10-a).

Proposed revisions to APM 740-11-c provides that individuals with specified academic administrative or Senior Management Group appointments who also hold a faculty title are eligible to accrue sabbatical leave credit. Thirty-three titles are included in the list. Some of the most distinguished UC Berkeley faculty have taken on the responsibilities of serving as administrators at the Lawrence Berkeley National Laboratory and have been denied a benefit accorded to other academic administrators. The Memorandum of Understanding with Lawrence Berkeley National Laboratory has provisions to ensure that the benefits provided to faculty working at the Laboratory should be consistent and equitable with those provided under the APM. It is recommended that the titles of Laboratory Director, Associate Laboratory Director and Deputy Director be added to the list of titles that are eligible to qualify for sabbatical leave service.

Proposal to delete APM 350.  On July 1, 2003, APM 390 (Postdoctoral Scholars) was issued. Transition guidelines were also issued that required appointees who were not postdoctoral scholars to be moved to other titles, established new title codes, and required the gradual phase out of Postgraduate Research and Visiting Postdoctoral Scholar titles with the retirement of these titles to be effective by January 1, 2010. These changes have rendered APM 350 obsolete. In addition, the reference in APM 350 to graduate students is no longer correct as graduate students have not been eligible for the Postgraduate Research title for some time. Given that APM 350 contains virtually no information on job duties, and individuals currently in the Postgraduate Research title are now subject to the provisions of APM 390, it is recommended that APM 350 be rescinded.

Re: Proposed Revisions to APM 710; and Proposed New APM 711 and 080

Enclosed for formal review are the following Academic Personnel Manual Policies described below:

  • APM 710 -- Leaves of Absence/Sick Leave

  • Proposed new APM 711 -- Reasonable Accommodation for Academic
        Appointees with Disabilities, and

  • Proposed new APM 080 -- Medical Separation

These proposed revisions have been developed in response to requests to clarify policy governing paid medical leave for academic appointees who do not accrue sick leave and to develop new policies for reasonable accommodation and medical separation for academic appointees.

Proposed revisions to APM 710 would establish a guaranteed amount of paid medical leave for full-time academic appointees who do not accrue sick leave and would provide guidelines for how and when medical information should be requested in support   of requests for such leave.  The proposal provides a maximum of six-months of paid medical leave within the first 10 years of employment to academic appointees with less than 10 years of UC service in titles that do not accrue sick leave.  For those with more than 10 years of service, the proposal provides a maximum of one year of paid sick leave in a 10-year period.  To put this in perspective, other eligible UC academic and staff appointees accrue 12 days of sick leave per year, and it takes almost 22 years for them to accumulate one year of paid sick leave.

Since the last systemwide review, “sick leave” has been clarified as “medical leave” for academic appointees who do not accrue sick leave, and wording was changed to address a concern about UCRP service credit and to clarify language on the transfer of accrued sick leave.

Proposed new APM 711 is needed to comply with Federal and State law.  It would provide guidance for the interactive process and reasonable accommodation, clarify levels of authority and emphasize that prior approval is necessary before medical separation can be approved.

Proposed new APM 080 outlines the process for medical separation of academic appointees who have exhausted leave and continue to be unable to work for health reasons and for whom reasonable accommodation is not possible.  APM 080 would provide a means to handle such cases differently from disciplinary actions due to misconduct or incompetent performance.

Enclosed for formal review are the following Academic Personnel Manual Policies described below:

Proposed revisions to APM 110-4 adds the definition of “domestic partner” to be consistent with the definition of domestic partner in Personnel Policies for Staff Members Section 2 (Definition of Terms).

Proposed revisions to APM 230-17 would allow for a total period of consecutive service not to exceed three years for appointees in the Visiting Assistant Professor Programs in Mathematics.  Proposal to delete APM 230-18-c which prohibits an appointee with a Visiting title in one of the schools of health sciences to be a member of special compensation plans of the schools.  Pursuant to APM 670 (Health Sciences Compensation Plan), individuals in the Visiting Professor title who meet specified conditions are eligible for membership in the Health Sciences Compensation Plan.

Proposed revisions to APM 279-20 would change “Conditions of Employment” to “Conditions of Appointment” because appointees in this series are volunteers.

Proposed revisions to APM 360-80-a would set forth normal periods of service at each rank and step for the Librarian series.  The periods are consistent with the periods set forth for unit members in Article 4.C. of the Memorandum of Understanding between the University of California and University Council – American Federation of Teachers for the Professional Librarian Unit.

Proposed revisions to APM 520-4 would add “child of a domestic partner” to the definition of near relative.

Proposed revisions to APM 710-14 would add a footnote to indicate that the Postgraduate Research and Visiting (_________) – Postdoctoral titles will be removed from the list of eligible titles for sick leave as of January 1, 2010.  Removal of these titles is consistent with Section 5 of the Transition Guidelines in APM 390 (Postdoctoral Scholars), Appendix A.  Revisions to APM 710-14 would also add “Project (e.g., Scientist) Series” to the list of Fiscal Year academic titles that are eligible to accrue sick leave.  APM 710-38 would add “domestic partner (same-sex or opposite-sex)” to conform with APM 715 (Leaves of Absence/Family and Medical Leave).  APM 710-46 would correct the reference from APM 145-7 to APM 145-36, which has been renumbered.

Proposed new APM 765 implements Section 103.8 of the Standing Orders of The Regents (Death Benefit) and to clarify eligibility criteria for academic appointees.  This proposal is consistent with Personnel Policies for Staff Members Section 83 (Death Payments).

These policies would apply to non-exclusively represented academic employees. The proposal is also available online at:

Re: Proposed Revisions to APM 700 and 710; Proposed New 080 and 711

Enclosed for formal review are two proposed policy revisions and two new proposed policies. These proposals have been developed in response to campus requests to clarify policy governing paid sick leave for academic appointees who do not accrue sick leave and to develop new policies for reasonable accommodation, medical separation, and constructive resignation.

The proposed changes are to:

Ô      APM 700 − Leaves of Absence/General

Ô      APM 710 − Leaves of Absence/Sick Leave

Ô      New APM 080 − Medical Separation

Ô      New APM 711 − Reasonable Accommodation for Academic Appointees with Disabilities

Proposed revisions to APM 700, Leaves of Absence/General, adds a new concept of constructive resignation for faculty who are absent without approval or do not return to assigned duties after an approved leave of absence for non-health reasons.

The proposed revisions to APM 710, Leaves of Absence/Sick Leave, provides guidelines for the amount of paid sick leave that may be granted to academic appointees who do not accrue sick leave and for how and when medical information should be requested.  The sick leave proposal provides a maximum of six-months of paid sick leave within the first 10 years of employment to academic appointees with less than 10 years of UC service in titles that do not accrue sick leave.  Appointees who do not accrue sick leave and who have more than 10 years of service would receive a maximum of one year paid sick leave in a 10-year period.  To put this in context, please note that other UC academic and staff appointees accrue 12 days of sick leave per year and it takes almost 22 years for appointees to accumulate one year of paid sick leave.
